HB 62 would allow any person in North Carolina to file a lawsuit against a city or county that they believe doesn't comply with the state’s anti-sanctuary law. Individuals could use the courts to force localities to allow its officials to engage in anti-immigrant practices such as interrogating people about their immigration status.

I am writing to urge you to vote against HB 62, Gov. Immigration Compliance/Enjoin Ordinances.

If enacted, HB 62 would open the floodgates to vigilante lawsuits against cities, counties, and sheriffs that do not cooperate with U.S. Immigration and Customs Enforcement (ICE).

Any person or a corporation in North Carolina could bring a lawsuit against a city or county government. The bill does not require that the person show that the policy personally harms them. HB 62 creates a potentially costly financial burden for localities, which are already under-resourced, and wastes taxpayer money to defend against these lawsuits.

Sheriffs and local entities could face costly lawsuits challenging sheriff policies limiting collaboration with ICE. HB 62 is a backdoor effort to penalize elected sheriffs who have recently ended the practice of honoring ICE detainers.
