House Bill 805 includes multiple provisions targeting transgender and nonbinary communities, as well as schools, in the state. These provisions include:

  • Requiring state officials to keep a person’s original birth certificate and new birth certificate on file together in a multi-page document after their sex designation has changed, which forces trans people to out themselves in situations where a birth certificate is needed.
  • Creating rigid definitions of sex and gender in state law that erase the existence of transgender, nonbinary, and intersex individuals.
  • Extending the time a patient has to bring a medical malpractice lawsuit in cases involving gender-affirming care in an attempt to intimidate providers.
  • Banning gender-affirming care for people in state prison or otherwise in the custody of the Department of Adult Correction.
  • Allowing parents to prohibit their child from checking out certain books in the school library for any reason.
  • Allowing parents to pull their child from any classroom activity or discussion that they believe burdens their religion.
  • Requiring schools to house children on field trips according to their assigned sex at birth.
