HB 372 included a provision that would allow homeowners and condominium associations to use automatic license plate readers (ALPRs) under specific conditions, including:

  1. Notifying a local law enforcement agency of the association's intent to begin using the system at least 30 days before the system is operational;
  2. Notifying all lot owners or unit owners of the association's intent to begin using the system at least 30 days before the system is operational;
  3. Adopting a written policy governing the system's use before the system is operational;
  4. Providing a local law enforcement agency ongoing access to the system.

The requirement to provide law enforcement ongoing access to the system is concerning because it automatically makes privately collected surveillance data available to law enforcement, increasing the government's ability to surveil private citizens entering or existing their homes. Update: ACLU-NC no longer opposes HB 372 since lawmakers removed the ALPR provision on 6/17/26.
